1.1 The present General Conditions are intended, together with the order form and the other elements referred to in them, to regulate the terms and conditions that will govern the provision of the Master Swiss Online Shop ("Service" or "Shop") by Mystic Star, Lda, NIPC 507459520, with headquarters at Avenida da Liberdade, 230, 8º, parish of Santo António, in Lisbon (hereinafter "Mystic").
1.2 The Service consists in making available, through the address https://masterswiss.com, access to the Online Store which, in addition to providing information on a set of products and/or services, allows the User, by electronic means, to order the products disclosed therein, under the terms and conditions described herein.
1.4. The User must provide Mystic with an email address, or the details of another form of contact, that is correct and complete and accepts that Mystic may contact him/her using those details if it deems necessary.
1.6. It is expressly forbidden to use the products and services for resale purposes.
1.7 Mystic reserves the right not to process orders received from users that indicate resale purposes or that are not in accordance with the present general sales conditions.
2.1 By submitting any orders for products disclosed in the Online Store, the User declares that:
2.2 Mystic reserves the right to impede the use of services or functionalities, as well as to block or delete personal information, upon notice, in situations of noncompliance with the legal terms or misconduct of the user, and to report possible illegalities or illegal acts to the authorities, if applicable.
2.3 To place an order, the User must follow the online purchasing procedure, choosing the product, the respective quantity, continuing with the filling out of the order form, which can only be submitted after the User confirms that he/she has read and accepted the present Online Store Purchasing Conditions. By doing so, the User enters into a purchase and sale contract with Mystic (the "Contract").
2.4 To complete the purchase the User must, before confirming the order, choose one of the following payment methods:
2.5 No payment method other than those mentioned will be accepted. If payment is made by an unauthorized method, Mystic cannot be held responsible for the loss of the payment or any other damages resulting therefrom.
2.6 Independently of the payment method chosen by the User, the order will only be processed after receipt of the payment, which will be automatically notified to Mystic and therefore it is not necessary to send any proof.
2.7 In the case of payment by Credit Card, all the details (card number or expiration date) will be sent by encrypted protocol to the company that provides the remote electronic payment services, without third parties having access to the transmitted information. This information will not be used by Mystic except to carry out the necessary procedures for the purchase or chargeback, in case of return, or for communication, to the police, in cases of suspected fraud.
2.8. By confirming the order, the User ensures that the credit card is his or her own or that he or she is the legitimate user of the payment card.
2.9 After submitting your order, the User will receive an email confirming receipt of your order and another confirming payment as soon as it is made.
2.10. By accepting these General Conditions, the Customer expresses its adherence and acceptance of the electronic invoice and accepts these terms for the provision of the same, considering its membership to be effected. To this extent, upon acceptance of the General Conditions, the Customer will only receive the invoice in electronic format.
2.11.In accordance with the provisions of the previous number, once payment has been received, the respective electronic invoice will be issued and immediately available in the customer area.
2.12. After receiving your order Mystic may verify some elements, namely, address, credibility and fraud verification. Confirming your order means that you agree with these conditions.
2.13. Orders with products purchased in pre-sale (informed on the product page) and other products available at the time of purchase, will be shipped only when the pre-sale products are available in stock.
3.1. Mystic reserves the right not to process orders, namely, in the following situations:
3.2 The non-payment of the order within 72 hours from the date in which it was confirmed by the user, implies its automatic cancellation.
3.3 If the User makes the payment after the deadline indicated in the previous number, Mystic does not guarantee the existence of conditions for the respective delivery. In this case, whenever the delivery is not made, the amount paid will be returned, minus any commissions charged to Mystic, according to the payment method adopted.
3.4. The User can cancel the order requesting it to Mystic through an email, which will be accepted without any charges as long as it has not been processed yet. In this case the amount paid will be returned, minus any commissions charged to Mystic, according to the payment method adopted.
3.5. Once your order has been processed, it will be delivered, but you have the option not to accept it, and the shipping and banking costs associated with the return will be borne entirely and exclusively by you.
3.6 For the cancellation effect, the user must indicate the following data to Mystic:
4.1. Payment information will be encrypted from the moment it is entered until the transaction is processed and will not be stored on a public server. Although Mystic uses encryption software, the security of information and payments transmitted over the Internet or via email cannot be guaranteed.
4.2. Mystic shall not be liable for any damages suffered as a result of the use of electronic means of communication including, but not limited to, damages arising from failure or delay in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for communications or virus transmissions.
5.1 In the case of a temporary stock shortage, the User's order will be suspended until delivery can be guaranteed. If this circumstance occurs, the User will be informed as soon as possible through the email indicated on the order form.
5.2 In case there is a rupture of only part of the products of the order, the User, assuming the corresponding shipping costs, will have the possibility of dividing the delivery of the products and should request it through the contacts available on the Website, identifying for the effect the order number and making reference to the rupture information provided by Mystic. If nothing is said by the User, the products in stock will be delivered, being reimbursed the price of the unavailable products.
6.1 Although they may be changed at any time, the price of products in the Online Store will be that which, at each moment, is announced for each product, remaining in force for the User who confirms and pays the order on that date, even if the delivery occurs at a later time.
6.2 Mystic will try to guarantee that all prices indicated on the website are correct, however errors may occur. If an error is detected in the price of any product ordered, the User will be informed as soon as possible and will be given the option to reconfirm the order with the correct price or the possibility of cancelling it. In case of impossibility of contact with the User, the order will be cancelled and the respective amount paid will be fully refunded. Mystic is not obliged to supply any product at a lower and incorrect price (even if an order confirmation and delivery message has been sent).
6.3 The prices of all products available in the Online Store include VAT at the legal rate in force, but do not include eventual shipping costs, which, if applicable, will be added to the total amount of the order to be paid by the User, before the respective confirmation.
7.1 Mystic does not sell products with defects or of inferior quality to the existing standards in the market. The main characteristics of each product shown on the Website are duly identified on the respective product page.
7.2 The products available on the Website may not correspond exactly in terms of image and colors due to the Internet browser and monitor used, and Mystic cannot be held responsible for these differences.
7.3 Mystic is not responsible for the losses or damages resulting from the non-fulfillment or defective fulfillment of the Service when this is not directly or indirectly attributable to it as intentional or grossly negligent, not being responsible, namely, for:
8.1. Products sold in the Online Store are available for delivery throughout the national territory and abroad. Deliveries are made to the address indicated by the User in the order form.
8.2 The shipping of the order placed depends on the time at which the customer makes the payment of the same, thus conditioning the delivery time. All orders paid on a business day up to 11:00 a.m. are processed.
8.3 The costs will be communicated to You when you place your order. By confirming your order you accept these costs and delivery times.
8.4 Unless out of stock or carrier delay, in the case of standard shipping, on average, deliveries are made in 2 to 3 working days, in any case delivery may take up to 7 working days in Portugal mainland and 7 to 60 working days to other destinations (islands and abroad), however the delivery time may be affected by delays and logistical problems in times of high demand as the festive seasons.
8.5 The shipping charges accepted by the Client at the time of the purchase correspond to a service provided by Mystic or its distribution partners that only aim to deliver that order from point A (warehouse) to point B (address indicated by the client). The delivery is considered done to any person that receives it at the agreed address and signs the delivery receipt.
8.6 To track an order in progress, the Customer should access his Customer Area and check the status of his order as well as its tracking number, or alternatively through Order Tracking by the order number and e-mail with which you registered.
8.7 If you do not claim your order from the shipping company within the time allowed and the order is returned to Mystic, you will have to pay the shipping costs of the new shipment. Any free shipping campaigns in force are only valid for the first shipment and do not apply to reshipments.
8.8 Upon delivery, you should inspect the packaging for any damage. If you find that the products are damaged, the customer should not accept the delivery of the order, which will be returned and should communicate the situation through the contact form or via e-mail. Mystic will proceed with the refund of the amounts paid for the order and shipping, as soon as the warehouse receives and completes the return process, after verifying the products.
8.9 Any claim of non-receipt of an order must be made within a maximum period of 30 days from the date the order was made. After this deadline, Mystic will not be responsible for the loss of the order.
Shipping rates are applied per order. The exact amount applicable to each order depends on the country of delivery and will be explicitly stated before the order is finalized.

10.1 The customer may return the delivered products if they are found to have defects or other non-conformities in relation to the products ordered, and such return can be made within 14 days after receiving the order. If the defects/non-conformities are confirmed, the price and the initial shipping costs will be refunded, as indicated in the following paragraphs.
10.2 The return indicated in the previous number does not affect the other rights provided by law, namely the rights related to the legal guarantee referred to in clause 11.
10.3 Products purchased in the Online Store may be exchanged or returned within 14 days from the date of receipt, provided that they are accompanied by all documentation received and that they are sent in the same conditions in which they were shipped, i.e., in good condition, with original outer and inner packaging unopened and without signs of use.
10.4 Mystic does not accept exchanges/returns of products of intimate nature or of use/direct contact with the skin.
10.5 The products will be exchanged or the amount paid will be refunded within 14 days, after the reception of the articles at Mystic facilities and the verification of the conditions mentioned in numbers 10.1. and 10.3.
10.6 The return or exchange in the cases referred to in the previous numbers must be preceded by written communication to be sent to the contacts available on the Website, indicating the customer's identification data, invoice number, as well as the products to be returned, the reason for the return and, when applicable, the desired product.
10.7 The return of the products must be done by the Customer within 14 days from the communication date referred in the previous number, being the Customer responsible for eventual damages in the products to be returned until the effective reception and verification of the products by Mystic.
10.8 The return should be made to the address indicated by Customer Support following the communication referred to in 10.6.
10.9 With the exception of returns based on defect or non-conformity of the products, the costs associated with the return are fully and exclusively borne by the Customer and, if necessary, Mystic can be directly compensated for them through a direct discount in the amount to be refunded to the Customer.
10.10. In any case, additional delivery costs will not be reimbursed when the Client has expressly requested a different and more onerous delivery method than the standard delivery proposed by Mystic.
10.11. The refunds will be made by the same method of payment, whenever possible, being deducted any commissions charged to Mystic, according to the payment method adopted. If the Customer has made the payment by ATM or MBWay reference, it is necessary that in the communication referred in number 10.6. it indicates the IBAN of the account where the reimbursement should be made.
10.12. If the conditions referred to in numbers 10.1. and 10.3. are not met, the return will be rejected, and an email will be sent to the Customer stating the respective reasons. The Customer will have, in this case, the option to request the reshipment of the products not accepted for return, the return postage being borne by the Customer.
11.1 All the products commercialized by Mystic have the guarantee foreseen in the national legislation, namely, in the Decree Law n.º 67/2003, of 8th April.
11.2 The product warranty does not cover:
12.1 Pursuant to the provisions of article 10 of Decree-Law 24/2014 of 14.02, the Customer has a period of 14 calendar days after the date of delivery of the products to be able to exercise the right of free termination of the contract.
12.2 The right of free withdrawal does not apply in the cases indicated in article 17 of Decree-Law no. 24/2014, of February 14, being, in particular, ruled out in the case of supply of products that cannot be returned for reasons of health protection or hygiene when opened after delivery, as is the case of intimate products or products of direct use/contact with the skin.
12.3 To exercise this right, the Customer must communicate to Mystic the will to terminate the contract through an unequivocal statement to be sent to the contacts available on the Website, using for this purpose the model of termination form annexed to Decree Law no. 24/2014, of February 14.
12.4 The return of the products must be done by the Client, at its expense, within 14 days from the date of the communication referred in the previous number. The Customer will be responsible for eventual damages in the products to be returned until the effective reception and verification of the products by Mystic.
12.5 The return should be made to the address indicated by Customer Support, following the communication referred to in number 12.3.
12.6 In case of termination of the Contract, confirming that the products are in the conditions mentioned in number 10.3, the payment made will be refunded to the User within a maximum of 14 days from the reception of the termination communication, less the transportation costs inherent to the collection, if any, the costs indicated in number 10.10, if applicable, as well as any commissions charged to Mystic, depending on the payment method adopted. However, Mystic reserves the right to withhold the reimbursement of the amounts paid by the User while the products are not received.
12.7 The Customer may not rescind the contract when the product transacted has, in any of its components, been made to the Customer's specifications or customized.
12.8 If the conditions referred to in number 10.3 are not met, the return will be rejected, and an email will be sent to the Customer stating the respective reasons. The Customer will have, in this case, the option to request the reshipment of the products not accepted for return, and the shipping costs will be borne by the Customer.

14.1 Promotional offers or commercial campaigns advertised in the Online Store are valid only for the period and under the conditions mentioned on the page of each product in promotion.
14.2 In case of return or exchange of items purchased under promotional offers, commercial campaigns or using promotional codes, the Customer will be credited or reimbursed only the amount actually spent on the purchase of the product to be returned or exchanged.
14.3 When used in accordance with the established rules, a promotional code entitles the user to a discount on the purchase of a specific product or for a set of products during the period indicated in the respective code.
14.4 Promotional codes may only be used in online purchases made on the site by their legitimate owners, and may not be sold, exchanged or given away.
14.5 The use of the promotional code is conditioned to only one use per order. Promotional codes cannot be combined with any other promotions or special offers.
14.6 Mystic reserves the right to correct any errors in the promotional codes, with the User being informed as soon as possible and given the option to reconfirm the order with the correct price or the possibility of cancelling it. In case of impossibility of contact with the User, the order will be cancelled and the respective amount paid will be fully refunded. Mystic is not obliged to supply any product at a lower and incorrect price (even if an Order and Delivery Confirmation message has been sent).
15.1 Although Mystic works its website with all care, the information, texts, graphic documents, movies, music and/or other services may, from time to time, contain errors or be incomplete or incorrect, which, as soon as detected, will be promptly rectified by Mystic.
15.2. The Online Store has adequate levels of security, however Mystic will not be responsible for any damages suffered by the User and/or third parties, due to delays, interruptions, errors and suspensions of communications that have their origin in factors beyond its control, namely, any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, the modems, the connection software or possible computer viruses or arising from the download ("download") through the service of infected files or containing viruses or other properties that may affect the User's equipment.
15.3 If for any reason of access error to the Website there is an impossibility to provide the service, Mystic will not be responsible for any possible damage resulting from it.
16.1 The User is not authorized to use or reproduce any of the trademarks or registered names used on the site, as this is a violation of the rights of the owners.
16.2. Everything concerning the design, texts, documents, films, music and/or other services of the site, the selection and organization thereof, as well as all software compilation and all other materials on the site are the property of Mystic and its suppliers.
16.3 Users/customers are only permitted to electronically copy and print portions of the site if this is necessary to place an order on the site or to use the site as a source for a purchase.
16.4 The User is not authorized to make any other use of the site or the information and materials contained therein, including reproduction for purposes other than those mentioned above, modification, distribution or republication.
16.5 If the User intends to use information or materials from the site he needs to obtain prior written authorization granted by Mystic.
To all issues regulated by the executed Agreement, namely regarding its validity, effectiveness, interpretation, integration, application or fulfillment, the Portuguese legislation will be applicable and they will be submitted to the exclusive jurisdiction of the Lisbon District Court, with express renounce to any other.
18.1.In the event of a consumer dispute, the User, if a consumer, may resort to the European Online Dispute Resolution Platform available at http://ec.europa.eu/consumers/odr or to the Consumer Alternative Dispute Resolution entities listed in the Directorate General for the Consumer (www.consumidor.pt ).
18.2 Mystic informs that it has not joined, nor is it bound to any ADR entity, and will verify, in the terms allowed by the applicable legislation, the most efficient alternative for the resolution of the dispute.
Mystic has the right to change these Terms & Conditions at any time. The Customer is subject to the principles and terms in effect at the date of its order, unless the law or competent authority imposes any change to them.
