General Terms & Conditions of Sale
1. Scope and Object of the General Conditions
1.1. These General Conditions are intended, with the order form, and the other elements referred to therein, to regulate the terms and conditions governing the provision of the Master Swiss Online Store Service (“Service” or “Store”) by Mystic Star, Lda, NIPC 507459520, with headquarters at Avenida da Liberdade, 230, 8º, parish of Santo António, in Lisbon (hereinafter “Mystic”).
1.2. The Service consists of making available, through the address https://masterswiss.com access to the Online Store which, in addition to providing information on a set of products and / or services, allows the User, by electronic means, to order the products disclosed therein, under the terms and conditions described herein.
1.4. The User must provide Mystic with an e-mail address, or the data relating to another form of contact, which are correct and complete and accepts that Mystic can contact him using such data, if deemed necessary.
1.6. The use of products and services for resale purposes is expressly prohibited.
1.7. Mystic reserves the right not to process orders received from users that indicate purposes of resale or that are not in accordance with the present general conditions of sale.
2. How to order
2.1. By submitting any orders for products posted on the Online Store, the User declares that:
- You need to have the legal age to use all services, namely eligibility to make purchases and respective payments, assuming that you are responsible and legally responsible for all acts performed by you on and through the website;
- You will use the site only to make legally valid inquiries or orders.
- You will not place any false or fraudulent orders;
- Accept the present general conditions, as well as other conditions existing in the Store, through links;
- The personal data provided by you for processing and sending orders submitted in the Online Store, namely email address, address and other contact details are true, allowing them to be used by Mystic, or by a partner hired for this purpose, to materialize delivery of orders;
- You are aware that if all the information on the order form is not provided, it will not be processed by Mystic.
2.2. Mystic reserves the right to prevent the use of services or features, as well as to block or delete personal information, by warning, in situations of non-compliance with the legal terms or misconduct of the user, and to participate in any illegalities or illegal acts to the users. authorities, if applicable.
2.3. To place an order, the User must follow the online purchase procedure, choosing the product, respective quantity, proceeding with filling out the order form, which can only be submitted after the User confirms that he has read and accepted these Purchase Conditions from the Online Store. In doing so, the User enters into a purchase and sale agreement with Mystic (the “Agreement”).
2.4. To complete the purchase, the User must, before confirming the order, choose one of the following payment methods:
- Paypal: You will be redirected to the PayPal website, and you must follow the payment procedures with your PayPal Account, through your Credit / Debit Card, quickly and safely, without sharing your financial information. It is not necessary to send any proof;
- Multibanco Reference: The Multibanco Reference (Entity, Reference and Amount) will be automatically generated in the Online Store and, in addition, an e-mail with this information will be sent to you.
- MB Way: You will be asked for the mobile phone number of the User associated with the MBWay account, and the payment must be confirmed in the notification that will be pending in the MBWay APP;
- Credit Card (VISA / AMERICAN EXPRESS and MASTERCARD): The User’s card details (name, number, validity and CVV code) will be requested to complete the purchase.
2.5. No payment method other than those mentioned will be accepted. If payment is made by an unauthorized method, Mystic cannot be held responsible for loss of payment or any other damages arising therefrom.
2.6. Regardless of the payment method chosen by the User, the order will only be processed after receipt of payment, which will be automatically notified to Mystic and it is not necessary, therefore, to send any proof.
2.7. In the case of payment by Credit Card, all details (card number or expiration date) will be sent by the encrypted protocol to the company that provides the remote electronic payment services, without third parties being able to access the information transmitted. This information will not be used by Mystic except to carry out the necessary procedures for purchase or refund, in case of return, or for communication, to the police, in cases of suspected fraud.
2.8. When confirming the order, the User ensures that the credit card is his or that he is the legitimate user of the payment card.
2.9. After submitting the order the User you willreceive an email confirming receipt of your order and another one confirming payment as soon as it is made.
2.10. By accepting these General Conditions, the Client expresses his adhesion and acceptance of the electronic invoice and accepts these terms for making it available, considering that his adhesion has been effected. Accordingly, after acceptance of the General Conditions, the Customer will only receive the invoice in electronic format.
2.11.In accordance with the provisions of the preceding paragraph, upon receipt of payment, the respective electronic invoice will be issued, which will be immediately available in the client area.
2.12. After receiving the order, Mystic will be able to verify some elements, namely, address, credibility and fraud verification. By confirming your order it means that you agree to these conditions.
3. Cancellation of orders
3.1. Mystic reserves the right not to process orders, namely, in the following situations:
- The product is no longer available/in stock;
- The billing information is not correct or verifiable;
- Check for any inconsistency in the User’s personal data;
- If the order is signaled by the Security Systems as incorrect or susceptible to fraud;
- If there are indications that the User is a reseller;
- If there are indications that the User is a minor and is not legally represented;
- It is not possible to deliver the order to the address provided, examples apart.
3.2. The failure of payment the order within 72 hours after the date on which it was confirmed by the user, implies automatic cancellation of the same.
3.3. If the User proceeds to the payment of the order after the period indicated in the previous number, Mystic does not guarantee the existence of conditions for carrying out the respective delivery. In this case, whenever the delivery is not made, the amount paid will be returned, deducted from any fees charged to Mystic, depending on the payment method adopted.
3.4. The User may cancel his order by requesting it from Mystic by e-mail, which will be accepted, free of charge, as long as it has not yet been processed. In this case, the amount paid will be refunded, deducted from any fees possibly charged to Mystic, depending on the payment method adopted.
3.5. After the order has been processed, the delivery will be made, but the User has the option of not accepting it, with the shipping and bank costs associated with the return being borne, entirely and exclusively, by the User.
3.6. For the purpose of cancellation, the user must provide the following data to Mystic:
- a) Order number;
- b) NIF of the person who placed the order and delivery address;
- c) Email of the person who placed the order.
4. Order security
4.1. Payment information will be encrypted from the moment they enter, until the transaction is processed and will not be stored on a public server. Although Mystic uses encryption software, the security of information and payments transmitted over the Internet or via e-mail cannot be guaranteed.
4.2. Mystic cannot be held responsible for any damage suffered as a result of the use of electronic means of communication including, but not limited to damage resulting from failures or delays in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for virus communications or transmissions.
5. Out of stock
5.1. In the event of a temporary stockout, the User’s order will be suspended until delivery can be guaranteed. If this circumstance occurs, the User will be informed as soon as possible through the email indicated on the order form.
5.2. If only part of the products in the order is broken, the User, assuming the corresponding shipping costs, will have the possibility to divide the delivery of the products, and must request it through the contacts available on the Website, identifying the order number for this purpose. and referring to the rupture information provided by Mystic. Nothing being said by the User will be delivered the products in stock, being refunded the price of the unavailable products.
6.1. Although they can be changed at any time, the price of products in the Online Store will be the one that, at each moment, is announced for each product, remaining in force for the User who confirms and pays the order on that date, even if the delivery takes place at a later time.
6.2. Mystic will try to ensure that all prices indicated on the website are correct, but errors may occur. If an error is detected in the price of any product ordered, the User will be informed as soon as possible, being given the option to confirm the order again, with the correct price or the possibility to cancel it. In case of impossibility of contact with the User, the order will be canceled and the respective amount refunded in full. Mystic is not obliged to supply any product at a lower and incorrect price (even though an order confirmation and delivery message has been sent).
6.3. The prices of all products available in the Online Store include VAT at the legal rate in force, but do not include any shipping costs, which, if applicable, will be added to the total value of the order to be paid by the User, before confirmation.
7.1. Mystic does not sell products that are defective or of inferior quality to the standards of those existing on the market. The main characteristics of each product shown on the website are duly identified on the respective product page.
7.2. The products made available on the Website may not correspond exactly in terms of image and colors, due to the Internet browser and monitor used, and Mystic cannot be held responsible for any of these differences.
7.3. Mystic is not responsible for the damages resulting from the non-fulfillment or defective performance of the Service when it is not directly or indirectly attributable as a result of intent or serious fault, and is not responsible in particular for:
- Errors, omissions or other inaccuracies regarding the information made available through the Service;
- Damage caused by the fault of the User or third parties, including intellectual property violations;
- Non-compliance or defective compliance that results from compliance with judicial decisions or administrative authorities; or
- Failure or defective compliance that results from the occurrence of force majeure situations, that is, situations of an extraordinary or unpredictable nature, external to Mystic and that cannot be controlled by it, such as pandemics, fires, power cuts, explosions, wars, riots, civil insurrections, government decisions, strikes, earthquakes, floods or other natural cataclysms or other situations not controlled by Mystic that prevent or hinder the fulfillment of the assumed obligations.
8. Shipping and delivery
8.1. The products sold in the Online Store are available for delivery throughout the national territory and abroad. Deliveries are made to the address indicated by the User on the order form.
8.2 The costs will be communicated to the User at the time of ordering. When confirming your order, the User is accepting these costs and delivery times.
8.3. Unless stock breaks or carrier delays, in the case of standard shipping, delivery may take between 2 to 7 business days in PT and 2 to 60 business days for Foreigners.
8.4. The shipping costs accepted by the Customer at the time of purchase correspond to a service provided by Mystic or its distribution partners that only aim to deliver that order from point A (warehouse) to point B (address indicated by the customer). Delivery is considered to be made to anyone who receives it at the agreed address and who signs the delivery receipt.
8.5. For the follow-up of an order in progress, the Customer you must access your Customer Area and consult the status of your order as well as the tracking number of the same, or alternatively through the Order Trackingby order number and e-mail with which you registered.
8.6. If the User does not claim the order with the carrier, within the time allowed and the order is returned to Mystic, he will have to bear the transport costs of the new shipment. Any free shipping campaigns in force are only valid for the first shipment, and do not apply to reshipments of orders.
8.7. Upon delivery, the customer must inspect the packaging in order to ascertain any damage. If the product is found to be damaged, the customer must not accept delivery of the order, which will be returned, and must report the situation via the contact form or via e-mail. Mystic will reimburse the amounts paid for the order and shipping, as soon as the warehouse receives and completes the return process, after checking the products.
8.8. Any claim for non-receipt of an order must be made within a maximum period of 30 days from the date of placing the order. After this deadline, Mystic cannot be held responsible for the loss thereof.
9. Shipping charges
Shipping charges are applied per order. The exact amount applicable to each order depends on the country of delivery, being expressly and itemized before finalizing the order.
10.1. The customer will be able to return the delivered products if he finds that they have defects or other non-conformities in relation to the ordered products, and such return can be made within 14 days after receiving the order. If the defects / non-conformities are confirmed, the price and the costs of the initial shipment will be refunded, under the terms indicated in the following numbers.
10.2. The return indicated in the previous number does not affect the other rights legally provided, namely, the rights related to the legal guarantee referred to in clause 11.
10.3. Products purchased from the Online Store, can be exchanged or returned within 14 days from the date of receipt, provided that they are accompanied by all documentation received and that they are sent in the same condition with which they were shipped, that is, in good condition , with original outer and inner packaging inviolate and without signs of use.
10.4. Mystic does not accept exchanges / returns of products of an intimate nature or of use / direct contact with the skin.
10.5. The products will be exchanged or the amount paid will be refunded within 14 days, after receiving the items at Mystic’s facilities and checking the conditions referred to in numbers 10.1. and 10.3.
10.6. The realization of the return or exchange in the cases referred to in the previous numbers, must be preceded by a written communication to be sent to the contacts available on the Website, with the indication of the customer’s identification data, invoice number, as well as the products to be returned, reason for the return and, when applicable, the desired product.
10.7. The return of the products must be carried out by the Customer, within a maximum period of 14 days from the communication date referred to in the previous number, and the Customer is responsible for any damage to the products to be returned until the actual reception and verification of the products by Mystic.
10.8. The return must be made to the address indicated by Customer Support, following the communication referred to in number 10.6 ..
10.9. Except for the return on the grounds of defect or non-conformity of the products, the costs associated with the return are borne, in full and exclusively, by the Customer, and, if applicable, Mystic can be directly reimbursed for them via the direct discount. the amount to be reimbursed to the Customer.
10.10. In any case, additional delivery costs will not be reimbursed, when the Client has expressly requested a different and more costly delivery method than the standard delivery proposed by Mystic.
10.11. Refunds will be made using the same method by which the payment was made, whenever possible, deducting any fees charged to Mystic, depending on the payment method adopted. If the Customer has made the payment by ATM or mbway reference, it’s necessary that in the communication referred to in number 10.6. indicate the IBAN of the account to which the refund should be made.
10.12. If the conditions referred to in paragraphs 10.1 are not met. and 10.3., the return will be rejected, and an email will be sent to the Customer indicating the respective reasons. In this case, the Customer will have the option of requesting the reshipment of products not accepted for return, with the reshipment charges being borne by the Client.
11.1. All products sold by Mystic are guaranteed under national legislation, namely, Decree-Law No. 67/2003, of 8 April.
11.2. The product warranty does not cover:
- Normal wear and tear of products, deterioration or accidents resulting from negligent use;
- Product interventions, namely repair attempts, or even repair, outside Mystic support services;
- Professional, improper or negligent use of the products;
- The color change of the product over time, due to oxidation of the finishes.
12. Right of Free Resolution
12.1. Under the terms of article 10 of Decree-Law 24/2014, of 14.02, the Customer has 14 calendar days, after the date of delivery of the products, to be able to exercise the right of free termination of the contract .
12.2. The right of free resolution does not apply in the cases indicated in article 17 of Decree-Law no. 24/2014, of 14 February, being, in particular, removed in the case of supply of products not susceptible to return for reasons of protection of health or hygiene when opened after delivery, as is the case with products of an intimate nature or of use / direct contact with the skin.
12.3. To exercise his right, the Client must communicate to Mystic the will to terminate the contract by means of an unambiguous statement to be sent to the contacts made available on the Website, being able to use the model of the resolution form attached to Decree-Law no. 24/2014, of 14 February.
12.4. The return of the products must be carried out by the Customer, at his expense, within a maximum period of 14 days from the communication date referred to in the previous number. The Customer will be responsible for any damage to the products to be returned until the actual receipt and verification of the products by Mystic.
12.5. The return must be made to the address indicated by Customer Support, following the communication referred to in number 12.3.
12.6. In case of termination of the Contract, confirming that the products are in the conditions mentioned in number 10.3., The payment made will be refunded to the User, within a maximum period of 14 days from the receipt of the resolution communication, being deducted the transport costs inherent to the collection, if any, the costs indicated in number 10.10., if applicable, as well as the fees possibly charged to Mystic, depending on the payment method adopted. Mystic reserves, however, the right to withhold the refund of the amounts paid by the User until the products are received.
12.7. The Customer cannot terminate the contract when the product transacted has, in any of its components, been made according to Customer specifications or customized.
12.8. If the conditions referred to in number 10.3 are not met, the return will be rejected, and an email will be sent to the Customer indicating the respective reasons. In this case, the Customer will have the option of requesting the reshipment of products not accepted for return, with reshipment charges being supported.

14. Promotions and Promotional Codes
14.1. The promotional offers or commercial campaigns published in the Online Store are valid only for the period and under the conditions mentioned on the page of each product under promotion.
14.2. In the case of return or exchange of items purchased within the scope of promotional offers, commercial campaigns or using promotional codes, the Customer will be credited or refunded, only the amount actually spent on the purchase of the product to be returned or exchanged.
14.3. When used in accordance with the established rules, a promotional code enables the user to enjoy a discount for the purchase of a specific product or for a set of products, during the period indicated in the respective code.
14.4 Promotional codes can only be used for online purchases made on the website by their legitimate owners, and their sale, exchange or donation is not allowed.
14.5. The use of the promotional code is subject to one use per order. Promotional codes cannot be combined with any other promotions or special offers.
14.6. Mystic reserves the right to correct any errors in the promotional codes, the User being informed as soon as possible, being given the option to confirm the order again, with the correct price or the possibility to cancel it. In case of impossibility of contact with the User, the order will be canceled and the respective amount refunded in full. Mystic is not obliged to supply any product at a lower and incorrect price (even though an Order and Delivery Confirmation message has been sent).
15. Information in the Online Store
15.1. Although Mystic works its website with great care, the information, texts, graphic documents, films, music and / or other services may, from time to time, contain errors or be incomplete or incorrect, which, as soon as detected, will be promptly rectified by Mystic.
15.2. The Online Store has adequate security levels, however Mystic will not be responsible for any losses suffered by the User and / or by third parties, due to delays, interruptions, errors and suspensions of communications that originate from factors beyond their control, namely, any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, modems, connection software or any computer viruses or resulting from downloading (“download”) through the infected files service or containing viruses or other properties that may affect the User’s equipment.
15.3. If for any reason of error in accessing the Website it is impossible to provide a service, Mystic will not be responsible for any losses arising therefrom.
16. Trademarks and copyright
16.1.The User is not authorized to use or reproduce any of the trademarks or registered names used on the website, as this constitutes a violation of the rights of the owners.
16.2. Everything regarding the design, texts, documents, films, music and / or other services of the website, the selection and organization of the website, as well as the entire compilation of software and all other materials on the website are the property of Mystic and its Providers.
16.3. Users / customers are only allowed to electronically copy and print portions of the website if necessary to place an order on it or to use the website as a source for purchase.
16.4. The User is not authorized to make any other use of the website or the information and materials contained therein, including reproduction for purposes other than those mentioned above, modification, distribution or republication.
16.5. If the User wishes to use information or materials from the website, he must obtain prior written authorization from Mystic.
17. Applicable law and jurisdiction
To all matters regulated by the Contract entered into, namely regarding its validity, effectiveness, interpretation, integration, application or compliance, Portuguese law will apply and will be submitted to the exclusive jurisdiction of the Lisbon District Court, with express waiver of any other.
18. Extrajudicial Dispute Resolution Mechanisms
18.1. In the event of a consumer dispute, the User, if a consumer, may use the European Online Dispute Resolution Platform, available at http://ec.europa.eu/consumers/odr or the Alternative Resolution Entities Consumer Disputes listed in the General Consumer Directorate (www.consumidor.pt ).
18.2. Mystic informs that it has not joined, nor is it linked to any RAL entity, and will verify, under the terms permitted by applicable law, the most efficient alternative for resolving the dispute.
19. Changing the Terms & Conditions
Mystic has the right to change these Terms & Conditions at any time. The Customer is subject to the principles and terms in force on the date of his order, unless the law or the competent authority imposes any changes to them.
